By accessing or using Orior AI ("Service"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, you may not access or use the Service. These Terms apply to all visitors, users, and others who access or use the Service.

2. Description of Service

Orior AI is an artificial intelligence-powered platform that enables users to generate visual content, including but not limited to UGC (User-Generated Content) characters, poses, and related imagery. The Service uses advanced AI models to create images based on text prompts and reference images provided by users.

3. User Accounts

To access certain features of the Service, you must create an account. When creating an account, you agree to:

Provide accurate, current, and complete information
Maintain and promptly update your account information
Maintain the security of your password and accept all risks of unauthorized access
Immediately notify us if you discover any unauthorized use of your account
Not share your account credentials with any third party

4. Acceptable Use

You agree not to use the Service to:

Generate content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
Create content that infringes on intellectual property rights of others
Generate deepfakes or content intended to deceive or mislead
Create content depicting real individuals without their consent
Generate sexually explicit or pornographic content
Produce content that promotes violence, discrimination, or hate speech
Attempt to reverse engineer, decompile, or extract the AI models
Use the Service for any unlawful purpose or in violation of any applicable laws
Interfere with or disrupt the Service or servers

5. Intellectual Property Rights

Your Content: You retain ownership of the prompts and reference images you submit to the Service. By using the Service, you grant us a non-exclusive, worldwide, royalty-free license to use your inputs solely for the purpose of providing the Service.

Generated Content: Subject to your compliance with these Terms and your subscription plan, you own the rights to the images generated through your use of the Service. You may use generated content for personal and commercial purposes.

Our Property: The Service, including its original content, features, and functionality, is owned by Orior AI and is protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

6. Subscription and Payments

Some features of the Service require a paid subscription. By subscribing, you agree to pay all applicable fees. Subscription fees are billed in advance on a monthly or annual basis depending on your chosen plan.

All fees are non-refundable except as required by law
We reserve the right to change subscription fees with 30 days notice
You are responsible for all taxes associated with your subscription
Failure to pay may result in suspension or termination of your account

7. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

We do not warrant that the Service will function uninterrupted, secure, or available at any particular time or location, or that any defects or errors will be corrected.

8. Limitation of Liability

IN NO EVENT SHALL ORIOR AI, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE.

9. Indemnification

You agree to defend, indemnify, and hold harmless Orior AI and its licensees and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses arising from your use of the Service or your violation of these Terms.

10. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease.

11. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

12. Governing Law

These Terms shall be governed and construed in accordance with the laws of the jurisdiction in which Orior AI operates, without regard to its conflict of law provisions.

13. Copyright Infringement (DMCA)

We respect the intellectual property rights of others. If you believe that content on our Service infringes your copyright, you may submit a takedown notice to our designated agent with the following information:

A description of the copyrighted work you claim has been infringed
A description of where the allegedly infringing material is located on the Service
Your contact information (name, address, phone number, email)
A statement that you have a good faith belief that use of the material is not authorized by the copyright owner
A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on their behalf
Your physical or electronic signature

Counter-Notification: If you believe your content was removed in error, you may submit a counter-notification with your contact information, identification of the removed content, a statement under penalty of perjury that you have a good faith belief the content was removed by mistake, and your consent to the jurisdiction of your local federal court.

Repeat Infringers: We will terminate the accounts of users who are found to be repeat infringers of intellectual property rights.

14. Alternative Model (Flexible)

Orior offers an alternative image model, shown as Flexible on the Orior website, that is more open with swimwear and fashion looks. It is available on the website only, not in the Orior iOS app. It runs only when you choose it, either when our default model declines an image or by selecting it yourself, and only after you accept the rules in this section. We ask you to accept them again whenever they change. Results from the alternative model may be less realistic than results from our default model.

By using the alternative model, you agree that:

You are 18 years of age or older
Every person shown is you, or an adult who gave you permission to use their likeness
You will not depict celebrities, public figures, or anyone whose likeness you do not have the right to use
You will not create nudity or sexual content
You will not depict anyone who is under 18 or who appears to be under 18
All rules in Section 4 (Acceptable Use) and the rest of these Terms continue to apply

Community and Templates: Images made with the alternative model cannot be shared to the community or published as templates. You remain responsible for anything you download and post elsewhere.

Enforcement: We record your acceptance of these rules and may review requests and results made with the alternative model. If you break these rules, we will suspend or terminate your account immediately and without refund, and we may report unlawful content to the authorities where the law requires it.

Removal Requests: If you believe an image shows you without your consent, write to support@oriorai.com. We will remove it within 48 hours of receiving a valid request.

We may change or withdraw this option at any time.
